It looks like the supposed victim was a consenting adult right up to the point when she got caught and fired.

Business is Business. If we were talking about Charlie Bell, and this led to the voided of his contract, she would be my hero. If she can seduce Biedrins, I say hire her back.

Smith said she had worked in the NBA for fourteen years, previously with the Washington Wizards and Phoenix Suns.

Her working for other NBA teams makes these accusations sound a bit more legitimate now…

But maybe the girls got paid for it? I don’t seem them filing anything about harassment.

It depends how it went down. They are professional dancers that work for Lacob. It’s not like they are accountants that were forced to dance for his pleasure. If they were compensated and it was conducted in a professional manner, I don’t think that necessarily constitutes sexual harassment.

Agreed.

The Warriors girls do a fair number of promotional performances. Saying they amount to sexual harassment seems like a huge stretch.

(Obviously, that sort of situation can easily be abused, where the dancers are acting under an implied threat that if they don’t engage in sexual activity with certain people they’ll be fired – but that’s not anywhere close to what’s alleged here).

I do, but as a Boston kid I’m congenitally incapable of mustering positive feelings for any New York team. It would take a master deprogrammer to erase that. The Knicks, Mets and Jets are far less loathsome than the MFY, but still have that dreaded NY before their names…

She says she was pushed into a wall by Juanika Ellis in the tunnel during a game.

Isn’t Juanika a cop? How is getting assaulted by a cop not something the supposed victim should have reported to the local police at the time? Where were her morals then? I guess she did not see a payday with that.

The team's statement:
When we were made aware of a consensual relationship between Mr. Ellis and the Plaintiff, we did what an organization should do. We told both to stop – promptly, directly and fairly. The Warriors have never taken any action against the Plaintiff for any inappropriate reason, and we deny the allegations she is making.

If they kept a paper trail – as they should have – this thing will end quickly.

Something is NOT adding up ???
Erika Smith is also suing the Warriors for failure to prevent harassment, retaliation, wrongful termination and intentional infliction of distress, among other charges.
Smith was encouraged to resign in mid-February or take money, according to the suit, which called the offer a bribe. The Warriors took away any of Smith’s work assignments that included Monta Ellis.

— If they removed her from things that included Ellis doesn’t it sound like they took action to prevent it? so why would she sue for failure to prevent harassment??

Smith was fired from her job as director of community relations on August 5, nine days after she told the Warriors a reporter contacted her about Ellis, according to the suit.

—- A reporter contacted her about Ellis ??? Why? If the harassment was a private internal matter then why would a reporter contact her and supposedly the reporter contacted her about stalking allegations…That sounds fishy to me

More to the point -

- the team is calling it a consensual affair that they were aware of.

IF they can back that up, her calling it harassment on Monta’s part pretty much destroys her credibility.

That being said, if she was fired or place in a less-desireable track because of that, she may have a case against the team.

Is her lawyer the same guy that tried to sue Hooters to force them to hire a homosexual male waitress? That guy has to be the king of frivolous lawsuits.

Disguisting if true to any extent!

I will wait until this is resolved and if they are guilty I’m out(as a fan) of this insane franchise and its “franchise” players.

The Usual

It seems like all these parties involved in this lawsuit are partially guilty of something at some time. In the end, someone (or more than one) will end up with a considerable amount of money, as things like this usually get settled.

The main thing that makes me suspicious...

is her claim that she played along with the whole thing, and “humored” Monta out of fear of retaliation. If true, that would seem to take away the responsibility from the Warriors. After all, if she did not make it clear that these advances were unwanted, what else are the W’s supposed to do?

All that leaves is the issue of why she was fired, which could still qualify for wrongful termination.
